Preliminary
1.     This marketing program is being run by DBS Bank Ltd. (“DBS”) on dl.flipkart.com/dl, Flipkart mobile app and Flipkart mobile site (collectively
“Platform”), which Platform is owned and operated by Flipkart Internet Private Limited
(“Flipkart”, “We” or “Our”). It is
open to all residents of India who is a digibank VISA Virtual debit card holder
with DBS in India (“Cardholder”).
2.     By participating in the Offer (defined below), Cardholder agree to be
bound by:
a. These Offer terms and conditions (“T&C”);
       b. All applicable terms and conditions of DBS.
3.     In order to be eligible for this Offer
1 as a DBS Cardholder, You must;
a. Download the digibank App;
b. If You are a new customer of DBS, you must enter
the promo code ‘FLIP’ on the sign up page and create an e-wallet (defined in
the key offer details as “Wallet”).
For existing customers of DBS, no promo code is required to avail this Offer;
c. Make a purchase of a minimum of Rs 400.00 on the
Platform of the products eligible for this Offer with Your digibank VISA

4.     In order to be eligible for this Offer

Other Terms and
Conditions 
6.
The Offer
1 will be applicable on the final cart amount of the relevant Fashion and
Lifestyle category of products only.
7.
In case of cancellation of Your order, the
transaction will not qualify for the Offer

8.
Add on cards will be treated as separate cards.
9.
The Offer is not applicable for Card on delivery
transactions.
10.
The Offer is not applicable on Gift Wrap or premium
delivery charges.
11.
The Offer benefits cannot be transferred or
assigned to any other person/customer.
12.
The Offer is not applicable on purchase of gift
cards and gold coins on the Platform.
13.
Offer 1 is not applicable in case of partial payments.
If a customer uses Flipkart EGV or Wallet for partial payment, no discount will
be applied under the above Offer.
14.
In case partial payment is made through Flipkart
gift card/ wallet for Offer 2, Offer 2 will be applicable only if the amount
paid through the Card is more than Rs. 250.
15.
In the event orders are partially cancelled
(during & outside the Offer Period) and if the total transaction amount
falls below the minimum transaction amount i.e. Rs. 400 for the Offer 1, the transaction will not
qualify for the Offer.
16.
In the event orders are partially cancelled
(during & outside the Offer Period) and if the total transaction amount
falls below the minimum transaction amount i.e. Rs. 250 for the Offer 2,
cashback will not be granted.
17.
DBS is not making any commitment to make any
offer beyond the Offer Period.
18.
Neither DBS nor Flipkart is liable or responsible
for any claim(s), dispute(s) regarding delivery, service, suitability,
merchantability, availability, quantity or quality made available to the
customers under the Offer on the products purchased/ services availed on the
Platform (shortly referred as “Claims”)
and the seller shall be liable for the same. In reference to any Claims, it
must be addressed in writing by You to Flipkart or directly to the concerned
seller and DBS shall not entertain any communication in this regard. Any query/
contention/ dispute raised by any customer to DBS with respect to the above
shall be forwarded to Flipkart for resolution.
19.
Customers are not bound in any way to participate
in the Offer. Any such participation is voluntary and the same is being made
purely on a best effort basis.
20.
DBS holds the exclusive right at its sole
discretion to refuse or deny the Offer to any Cardholder. The Cardholder shall
become ineligible to participate in the Offer if his/her Card is suspended
before the expiry of /during the Offer Periods.
21.
All applicable taxes, liabilities or charges
payable to the Government or any other authority or body, if any, shall be
borne directly by the Cardholder.
22.
If any Offer and/or anything to be done by DBS or
Flipkart in respect of the Offer is prevented or delayed by causes,
circumstances or events beyond the control of DBS or Flipkart, including but
not limited to, tampering, unauthorized intervention, interception, fraud,
technical failures, floods, fires, accidents, earthquakes, riots, explosions,
wars, hostilities, acts of government, or other causes of like or similar or
other  character beyond the control of DBS or Flipkart, then DBS and/or
Flipkart shall not be liable for the same to the extent so prevented or
delayed, and will not be liable for any consequences and on occurrence of such
event, the Offer may be withdrawn at the discretion of DBS.
23.
These T&C shall be governed by the laws of
India. Any disputes arising out of and in connection with this program shall be
subject to the exclusive jurisdiction of the Courts in Bangalore only.
24.
Under no circumstance will the Offer being
offered be settled in cash.
25.
DBS and Flipkart reserve the right to, without
prior notice and without assigning any reason whatsoever,
add/alter/modify/change or vary all of these T&C or to replace, wholly or
in part, the Offer by another offer, whether similar to the Offer or not, or to
extend or withdraw it altogether.
26.
Flipkart or the sellers shall not be liable for
any failure by DBS to honour the transaction due to any technical issues as a
result of which the transaction made by the Cardholder was not successful.
27.
DBS or Flipkart shall also not be liable for any
loss or damage whatsoever that may be suffered, or for any personal injury that
may be suffered, to a customer, directly or indirectly, by use or non-use of
products/ services under the Offer.
28.
The Cardholder shall indemnify and hold Flipkart,
DBS and seller harmless against all damages, liabilities, costs, expenses,
claims, suits and proceedings (including reasonable attorney’s fee) that may be
suffered by such sellers as a consequence of (i) violation of these terms and
conditions, of the terms of user agreement, privacy policy (subject to change)
as mentioned on the Platform; (ii) violation of applicable laws; and (iii) any
action or inaction resulting in wilful misconduct or negligence on the part of
the customer.
29.
Any query regarding the Offer will be entertained
till the end of the Offer Period i.e. 25th March 2018 (23:59
hours) for Offer
1. Any query regarding the Offer 2
will be entertained till 20th April 2018. Post such date, Flipkart
or DBS will not entertain any correspondence or communication regarding the
Offer from any customers/ persons. Pictures of
products shown in the communication sent to the customer either through mailers
or advertised on the Platform, are representative only and may not bear a
resemblance to the actual products.  None of the parties shall under any
circumstances be responsible towards the same.
30. Products under this Offer are subject to
availability from the respective participating merchants/sellers of Flipkart
and accordingly DBS or Flipkart in no circumstances shall be liable for
non-availability of any of the products.
31. This
document is an electronic record in terms of Information Technology Act, 2000,
